The Accra High Court has found Aisha Huang, guilty of engaging in mining operations without a license and of illegally entering Ghana while barred from re-entering the country.
The court have therefore sentenced her to four years in prison. Judge Lydia Osei Marfo presided over the court, which also fined Aisha Huang GHC48,000.
Aisha Huang was jailed and fined with the following charges;
I)”Undertaking a mining operation without a licence which is contrary to section 99(2)(a) of the Minerals and Mining Act, 2006, Act 703 as amended by the Minerals and Mining (Amendment) Act 2019, Act 995″ was the first charge brought against Aisha En Huang.
ii)According to the Minerals and Mining (Amendment) Act, (2019), Act 995, the second accusation is “facilitating the participation of persons engaged in a mining operation contrary to section 99 (2)(a) & (3) of the Minerals and Mining Act, 2006, Act 703.”
iii)”Illegal employment of foreign nationals contrary to section 24 of the Immigration Act, (2000), Act 573″ was the third count on the charge sheet.
According to the authorities, En Huang Aisha illegally hired four Chinese nationals—Gao Jin Cheng, Lu Qi Jun, Haibin Gao, and Zhang Zhipeng—in May 2017 to labor at an illegal mining site in the Ashanti Region’s Amansie Central District.
iv)The final charge is “entering Ghana while prohibited from re-entry contrary to section 20(4) of the Immigration Act, (2000), Act 573.” The state argues that En Huang Aisha was arrested in Kumasi on September 2, 2022, and that it was discovered that she had returned to Ghana knowing that she had been forbidden from doing so.
Attorney General Godfred Yeboah Dame filed charges against Aisha Huang after it was alleged that she conducted mining operations in Ghana without the required licensing system. She was found guilty by the court of all four of the allegations brought against her.
After being found and apprehended again in Ghana several years after her deportation, Aisha Huang’s case garnered notice when the Attorney General took over in November 2022. Aisha Huang was refused bail and kept in jail throughout the trial.
