The General Secretary of the National Democratic Congress (NDC), Johnson Asiedu Nketia has said the leadership of the party have not been served with any court order restraining them to embark on demonstrations in Accra.
The Accra Regional Police Command few days ago announced that it has secured a restraining order against the leading opposition party from embarking on protests and demonstrations in the nation’s capital.[ads2]
The statement from the police states that the NDC are to stop embarking on protests and demonstrations from December 30, 2020 to January 10, 2021.
This comes after the NDC had embarked on numerous of protests at the Electoral Commission headquarters with one of the protests leading to the arrest of twenty-six (26) supporters of the party who had no permission before embarking on the protest.[ads3]
But speaking on GHOne TV, Johnson Asiedu Nketia said that the police acted wrongly by preventing the NDC from embarking on demonstrations with an exparte motion.
“It has been established, so what did they think they’re doing? they are just playing games, and as we sit here nobody has been served with any process. It means that nothing exists. The Police cannot go and claim they have secured an exparte motion, nobody had been served with that motion and then they themselves will go and then issue a statement that they have secured exparte motion so so and so…when they themselves know that the established principle is that you cannot stop demonstrations with exparte motions; you must come with motions on notice.” he said…[ads4]
” Your leadership has not been served with any court process so the statement issued by the Police… I don’t know if its foundation is on any court order, as we sit here we’ve not been served with any court order so we cannot attest to the fact that there is a court order and if there is no court order then their planned activities should continue,” he stressed.[ads5]
